Privacy Statement for California Employees, Ex-employees & Job Candidates

In accordance with the California Consumer Privacy Act as amended by the California Privacy Rights Act (“CCPA”) the following notice provides information regarding the categories of personal information we collect about our employees and the business or commercial purposes for which personal information will be used.

Performing services on behalf of the business, including maintaining or servicing accounts, administering benefits, legal compliance, payroll, providing customer service, billing for service and collecting payments, verifying customer and personnel information, providing advertising or marketing services, utilizing analytic services or providing similar services on behalf of the business or service provider; detecting security incidents, protecting against malicious, deceptive, fraudulent, or illegal activity, and prosecuting those responsible for that activity; undertaking activities to verify, upgrade, enhance or maintain the quality of our products or services.

 

Information is retained for the period of employment or for the duration of any receipt of benefits (whichever is longer) and for at least 5 years thereafter or as required by applicable law.

Sensitive Personal Information

Identifiers: Social Security number, driver’s license number, log in credentials, financial account information, precise geolocation, racial or ethnic origin, union membership, contents of email/voicemail, instant messages and text messages when using company equipment biometric information, medical information associated with workers comp claims

Information is retained for the period of employment or for the duration of any receipt of benefits (whichever is longer) and for at least 5 years thereafter or as required by applicable law. Geolocation information is retained for 1 year.

Employment Application information

To facilitate the employer-employee relationship, the following information will be collected for business purposes. This may include your resume, application form, work history, work permit information if applicable, education, degrees, academic records, languages and qualifications, references, citizenship/nationality, date of birth, gender, and other protected class data to the extent it is disclosed during the application and recruitment process, and any professional licenses, memberships, or certifications. May also include pre-screening information through a 3rd party background vendor that includes verification of your identity, address, or references and, where permitted by local law, the verification of background checks (including criminal or judicial data) about you in accordance with applicable law.

 

Information is retained for the period of employment if applicable or for at least 5 years if not employed.

Employment information

To facilitate the employer-employee relationship, the following information will be collected for business purposes. This may include your employee identification number, social security number, passport number, driver’s license, company photo, badge number, job title and description, department and manager, reporting lines, work location, cost center, business unit or group, work status such as full time or part time, working hours, performance reviews; training information, salary history which may include commissions and bonuses, benefit history.

 

Information is retained for the period of employment or for the duration of any receipt of benefits (whichever is longer) and for at least 5 years thereafter or as required by applicable law.

Information in Customer/Human Resource Records

Performing services on behalf of the business or service provider, including maintaining or servicing accounts, administering benefits, legal compliance, payroll, providing customer service, processing or fulfilling orders and transactions, verifying customer and personnel information, processing payments, providing financing, providing advertising or marketing services, utilizing analytic services, or providing similar services on behalf of the business or service provider; responding, on a priority basis, to outages or trouble tickets for certain customers that provide us with limited medical information; detecting security incidents, protecting against malicious, deceptive, fraudulent, or illegal activity, and prosecuting those responsible for that activity; undertaking activities to verify, upgrade, enhance or maintain the quality of our products or services.

 

Information is retained for the period of employment or for the duration of any receipt of benefits (whichever is longer) and for at least 5 years thereafter or as required by applicable law.

Internet or other electronic network activity (information regarding your interaction with our Sites or advertisements)

Performing services on behalf of the business, including providing analytic services; auditing related to a current interaction with the consumer and concurrent transactions, and auditing compliance with this specification and other standards; detecting security incidents, protecting against malicious, deceptive, fraudulent, or illegal activity, and prosecuting those responsible for that activity; short-term, transient use, although no personal information is disclosed to third parties and is not used to build a profile about a consumer or otherwise alter an individual consumer’s experience outside the current interaction; undertaking internal research for technological development and demonstration.

 

Information is retained for up to 5 years.

Commercial information (products or services purchased, obtained, received  or considered, other purchase or consuming histories or tendencies)

Auditing related to a current interaction with the consumer and concurrent transactions; performing services on behalf of the business including processing or fulfilling orders and transactions, verifying customer information and processing payments; undertaking activities to verify, upgrade, enhance or maintain the quality of our products or services.

 

Information is retained for the period of time you receive services and for at least 4 years thereafter or as required by applicable laws.

 

Notice to California Residents – Your CCPA Rights

As a California resident, you have certain rights, pursuant to the California Consumer Privacy Act as amended by the California Privacy Rights Act (or “CCPA”). These CCPA rights may only apply in certain circumstances and are subject to certain exemptions. Please see the table below for a summary of your rights. Right to Know

As a California resident, you have the right to request that we disclose what personal information and sensitive personal information we collect, use, disclose, share and/or sell. All employee related personal information, including sensitive personal information, that we collect on you is located in your PeopleSoft account. We do not sell your personal employee related information.

Right to Request Deletion

As a California resident, you have a right to request the deletion of your personal information and sensitive personal information collected or maintained by us.

Right to Limit Use or Disclosure

As a California resident, you have a right to limit the use and disclosure of your sensitive personal information if used for reasons other than those allowed by the CCPA (information necessary for providing, billing and collecting for your services and to facilitate the Employer/Employee relationship).

All sensitive personal information that we collect or disclose is used for the reasons allowed by the CCPA.

Right to Opt Out of Sale or Sharing

As a California resident, you have a right to opt out of the sale or sharing of your personal information.

We do not sell your personal information.

Right to Correct

As a California resident, you have a right to request correction of inaccurate personal information maintained by us.

Right to Non-Discrimination

As a California resident, you have a right to non-discriminatory treatment and no retaliation by us for exercising any of your CCPA rights.

Authorized Agent

As a California resident, you can exercise your CCPA rights or you can designate an authorized agent to make a request on your behalf.
