NOTICE: Using Your Landline Telephone Service for 911 and Other Calls During a Power Outage1

Your Consolidated Communications, Inc. (CCI) telephone service is provided over our Fiber to the Premises (FTTP) network. The FTTP network uses hair-thin strands of glass fiber and laser-generated pulses of light called fiber optics to transmit your voice communications. This very reliable network differs from CCI’s more traditional copper wire based network in one key way: If electrical power is lost at your home, your landline voice telephone service will not work and you will not be able to dial 911 in an emergency unless you have a working backup power source.

When CCI installed your telephone service using the FTTP network, a Backup Power Unit (BPU) was installed at your home. The unit contains a battery initially capable of providing up to 8 hours of backup power in the event of a power outage.

This notification is to inform you that there is also a commercially available 24 hour solution for a standby Battery Backup Unit (BPU), in the event that you would like to purchase this to support your CCI telephone service during a power outage. While CCI will not install a 24 hour BPU in your home, we have identified where you can purchase and install such a BPU at your expense. If you purchase and properly install this BPU, you will be able to continue to use your CCI landline voice service during a power outage for as long as the BPU retains a sufficient charge.

If CCI deployed a CyberPower back up power unit in your home, the CyberPower CS20A-EBP, a 24 hour Battery Backup Unit (BPU), is compatible with that equipment. Please see the attachment for model information as well as installation documentation for CyberPower CS20A-EBP.

Follow “How to Buy” directions on the CyberPower site for this information. You may be able to purchase another brand of compatible equipment, which must be rated at 20ah/12V.

Please keep in mind that, while a BPU will allow you to continue to use your CCI landline voice service for a limited time during a power outage, the BPU will not power any other CCI equipment at your home, including your modem or router. Therefore, you will not be able to make calls using a Voice over Internet Protocol (VoIP) service and will not have access to the Internet or any other non-landline voice services during a power outage. Additionally, the BPU will not power cordless phones, devices used to assist with disabilities, or other medical devices, and these devices will not work in the event of a power outage. It is your responsibility to ensure that the proper battery backup solutions have been put in place for this equipment and these other devices to ensure their operation during a power outage.

In addition, many factors impact the life and operation of a back-up power battery, including temperature, age, and whether the battery has been misconfigured or damaged. The lifespan of the BPU’s battery is typically 2-5 years depending on how often it is used and its environment. The BPU charge will deplete during a power outage and will deplete faster when you use your landline voice service during an outage. One method of extending the duration of backup power may include purchasing additional batteries and rotating them during a power outage.

Under normal circumstances, when power is restored to your home, the BPU recharges the battery without any additional action required by you. The initial charge can take up to 24 hours. You are responsible for the monitoring, testing and management of the BPU and associated battery. The BPU should also be placed in a location at your home which allows you to monitor its status.

The information in this notice is provided to educate you on the need for BPU with your current telephone service provided over CCI’s FTTP network, and you should contact the BPU provider, CyberPower, with any questions regarding any BPU you purchase from them. CCI MAKES NO WARRANTIES REGARDING THE BPUs YOU PURCHASE FROM THEM OR ANY OTHER BATTERY BACK-UP SOLUTIONS YOU PROVIDE AND USE IN CONNECTION WITH YOUR CCI SERVICES. If your purchased BPU or other battery back-up products are no longer functioning, CCI is not responsible for any replacement or maintenance. You are responsible for all costs associated with the purchased BPU or any other battery back-up products.

Additionally, if you are unable to use your landline voice service during a power outage due to the inoperability of your BPU or any other third party product, CCI will not provide any credits to your service charges during the service interruption.

As set forth in our tariffs, customer agreements, and other terms applicable to your CCI landline voice and other services, CCI does not warrant that its services will be uninterrupted or error-free. Additionally, the purchased BPUs and other battery back-up products you may use may not be sufficient to maintain CCI’s services, including its landline voice service, throughout the duration of a given power outage. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, CCI WILL NOT BE LIABLE FOR ANY PERSONAL INJURY OR PROPERTY DAMAGE OR OTHER DAMAGE OR INJURY CAUSED BY THE BPUs OR ANY OTHER BATTERY BACK-UP PRODUCTS NOR WILL CCI HAVE ANY LIABILITY FOR THE FAILURE OF BPUs OR ANY OTHER BATTERY BACK-UP PRODUCTS TO POWER YOUR LANDLINE PHONE SERVICE OR ANY OTHER CCI SERVICE DURING A POWER OUTAGE.

For clarity, CCI’s tariffs, customer agreements, and other applicable terms of service will continue to govern your use of CCI’s landline voice and other services, and you should refer to those terms for additional details regarding the limitations of CCI’s responsibility for your use of, or inability to use, those services.
